Subject: - Education Cess and Secondary and Higher Education Cess – reg.

Representations have been received from the field formations, seeking clarification regarding the applicability of service tax exemption to Education Cess (refers to both Education Cess leviable under Finance (No.2) Act, 2004 and Secondary and Higher Education Cess leviable under Finance Act, 2007), under notifications where ‘whole of service tax' stands exempted. Apparently the doubt arises in the context of Tribunal’s Order in the matter of M/s. Balasore Alloys Ltd. Vs CCE, Customs and Service Tax, BBSR-I (2010-TIOL-1659-CESTAT-KOL).

2. The issue has been examined. Though Tribunal’s Order referred above is in favor of revenue, it is inconsistent with the policy intention of the Government to exempt education cess in addition to service tax, where ‘whole of service tax’ stands exempted. According to section 95(1) of Finance (No.2) Act, 2004 and section 140(1) of Finance Act, 2007, Education Cess and Secondary and Higher Education Cess are leviable and collected as service tax, and when whole of service tax is exempt, the same applies to education cess as well. Since Education Cess is levied and collected as percentage of service tax, when and wherever service tax is NIL by virtue of exemption, Education Cess would also be NIL.

3. This being the principle, field formations are directed not to initiate proceedings to recover the education cess, where ‘whole of service tax’ stands exempted under the notification. Extending the same principle, where education cess has been refunded to exporters along with service tax, by virtue of exemption notifications where ‘whole of service tax’ is exempt, the same need not be recovered.

Focus on employment-oriented education: World Bank
The World Bank on Monday urged countries across the globe to focus more on education that prepares young people for the jobs market rather than on the time they spend in school.

Better learning for all students worldwide is vital because economic growth, better development, and significantly less poverty depend on the knowledge and skills that people gain, not the years spent in a classroom, it said while launching its education strategy for the next decade.

In the new strategy, the Bank reaffirms its commitment to helping countries get all children into school by the 2015 deadline for the Millennium Development Goals (MDGs).

There is a record 210 million people out-of-work globally, with employers reporting too few workers to hire with the right skills.


It said the global conditions were changing rapidly with a surge of young people at the secondary and tertiary levels in the Middle East and many emerging economies and the rise of new middle-income countries anxious to boost their economic competitiveness by training more skilled, adaptable workforces.

"For developing countries to fully reap the benefits of educationboth by learning from ideas and through innovation they need to unleash the potential of the human mind. And there is no better tool for doing so than education," said the World Bank President Robert B Zoellick.

P Govt employees taking part in protests to face action
Hyderabad, Apr 13 (PTI) The Andhra Pradesh Government today issued a Government Order (GO) that enables authorities to take disciplinary action against employees who indulge in protests like non-cooperation and tool down, drawing a sharp criticism from pro-Telangana groups.

Holding that the protests are not in public interest, the GO directed the authorities to furnish day-to-day reports on agitation programme to the Government.

It asked them to monitor the employees, who sign in the attendance register and do not attend normal work, and also adopt the 'no work, no pay' policy strictly.

Coming down heavily on the GO, TRS President K Chandrasekhar Rao said it is against the right of employees to protest.


Training his guns on Ministers from Telangana region, he said they should make it clear whether they were a party to such a directive.

The Ministers from Telangana should either get the GO cancelled or quit their posts, he said.

Sujject :- Submission of immovable Property Returns by officers of Group A Central Services for the year 2010 (as on 01.01.2011) - Placing of the public domain regarding.


Rule 18(1) (ii) of the CCS (Conduct) Rules have provision for submission of annual property returns in respect of immovable property by all Group 'A' and 'B' officers by 31st January of each year. Conduct Rules for Railways and other Rules in respect of Central Government servants contain similar provisions.


2. It has been decided that the immovable property returns submitted by members of all Group 'A' Services of the Central Government for the year 2010 i.e.as on 01.01.2011 will be placed in public domain by the respective cadre controlling authorities by 31.05.2011. A copy of the circular in this connection issued by
Establishment Officer to all Ministries/Departments is also enclosed herewith.

3. All the Cadre Controlling authorities in respect of Group 'A' Central Services are requested to ensure compliance. They are also requested to report status on 31.05.2011.

New Delhi, Apr 13 (PTI) The first meeting of the newly-constituted joint committee comprising ministers and civil society activists to draft the Lokpal Bill will be held on Saturday.

To be held on April 16, the meeting will be chaired by Finance Minister Pranab Mukherjee, who is the chairman of the committee formed by the government to draft the bill following an agitation

launched by social activist Anna Hazare, sources in the government said.

Besides Mukherjee, members of the committee are Home Minister P Chidamabaram, Law Minister Veerappa Moily (Convenor), HRD Minister Kapil Sibal and Water Resources Minister Salman Khurshid.


The civil society will be represented by Hazare, former Supreme Court judge N Santosh Hegde, former Law Minister Shanti Bhushan (Co-Chairperson), lawyer Prashant Bhushan and RTI activist Arvind  Kejriwal.

Please refer to this Board's letter of even number dated 10.06.2009 wherein the financial upgradation under the Modified Assured Career Progression Scheme (MACPS) has been allowed upto the highest Grade Pay of Rs.12000/- in the Pay Band-4. Consequent upon introduction of the new HAG scale of Rs.67000-79000 in replacement of Rs.37400 - 67000 with Grade Pay of Rs.12000 in PB-4, it is clarified that the benefits of financial upgradation under the MACPS shall be available to the aforementioned HAG scale also.

Streamlining procedure for scrutiny of income-tax returns

Scrutiny of income tax returns is an important mechanism for ensuring taxpayer compliance and to counter tax-evasion. However, it has evoked some concern from small taxpayers and senior citizens about prolonged enquiries. Concerns have also been raised about selection of the same cases in scrutiny year after year.

Appreciating the concern of these taxpayers and with a view to mitigate their hardships, Central Board of Direct Taxes has reviewed its scrutiny selection procedure. In order to redress the grievance, it has been decided that during the financial year 2011-12, cases of senior citizens and small taxpayers, filing income-tax returns in ITR-1 and ITR-2 will be subjected to scrutiny only where the Income Tax department is in possession of credible information.


Senior citizens for this purpose would be individual taxpayers who are 60 years of age or more. Small taxpayers would be individual and HUF taxpayers whose gross total income, before availing deductions under Chapter VIA, does not exceed Rupees ten lakh.

Think out of the box. Try to frame your own questions like the ones above from the Census data. The more uncommon or unconventional the better. It means you’re seasoning up to the IAS exam and your progress bar is moving in the right direction.

New Pension Scheme for railway employees challenged

New Pension Scheme for railway employees challenged

The new pension scheme introduced by the Union Government for railway employees has been challenged in the Madras Bench of the Central Administrative Tribunal.

An employee of the southern railway and Dakshin Railway Employees Union (DREU) have challenged the scheme terming it unconstitutional and invalid.

According to the new scheme, employees appointed on or after 01.01.1994 in the Railways would be governed by the new pension scheme which would be governed by ‘Pension Fund Regulatory Development Authority’ which would function under the overall control of Ministry of Finance. According to the new scheme, 10% of Pay and DA of an employee would be deducted and an equal amount would be contributed by the central government.

The entire pension scheme is being authorized through various executive orders, which cannot be done to govern the retirement benefits of government employees which has to be in tune with Articles 41 to 43 of the Constitution, alleges the application. The notifications issued by the government constituting PFRDA dated 10.10.2003 and 14.11.2008 are unconstitutional, as they have not been issued by the President of India and authenticated as required under Article 77 of the Constitution and the ordnance sanctioning this also lapsed in 2005, which renders the entire process without authority of law alleges DREU in its application.

The new pension scheme, which is mandatory to government employees curtails them from exercising any option said V. Daniel, a Helper in Southern Railway. According to the New Pension Scheme, any citizen of India can join the Scheme and they can choose their Fund Managers or opt for different schemes whereas no such option is available to government servants.

The application also raised serious apprehension over the way in which their funds are being exposed to market risk and they cite the risk clause in the offer document of the NPS which says that “there are no guarantee on investments and investments involve risks such as trading volumes, settlement risk, liquidity risk, default risk, including possible loss of principal’. The application also cited the statement of PFRDA Chairman that pension fund managers regulated by PFRDA are not giving minimum guarantee on returns in their products.

Besides seeking quashing of the notification and grant retiral benefits to all employees on par with those who joined prior to January 1994, the application sought an interim injunction against the notification and also to release family pension and gratuity to certain employees who died after the introduction of the new scheme.

The matter came up before the Madras Bench of the CAT comprising Members K. Elango and R. Satapathy. Counsel R. Vaigai advanced arguments on behalf of the DREU and highlighted how the funds of the employees are being entrusted with private players and are subjected to undue risks. She also apprised the Bench that the government as an employer cannot transfer its funds to a private player and expect him to discharge government’s obligation.

After hearing the arguments on behalf of the applicant and of the central government, the Bench ordered interim relief directing the railway authorities to offer gratuity and family pension to all employees who joined after January 2004 within four weeks from the date of application and posted the matter for June 1.

Employee Provident Fund (EPF) : Retire as a Crorepati
We normally hate any kind of deductions in our monthly salary slips – either its income tax deduction , professional tax deduction or even an EPF deduction.Very few of us really know that this small EPF deduction each year can in reality make you a crorepati by the time you retire. Encouraging fact is that this statement is applicable to even with those having modest salaries. There’s many if’s and but’s to achieve that , most notably being resisting the temptation to withdraw money till retirement.
12% of your basic salary that gets deducted as part of EPF account every month has a potential to make you a crorepati by the time you retire. Most of us are of view that investment is so small and interest rate offered is nothing special. Power of compounding clubbed with a matching contribution from your employer every month can do wonders for you.
Encouraging stats : 8.5% interest earned on the EPF can help a person with a basic salary of 25,000 a month accumulate a mammoth 2.4 crore in 35 years. Sounds unbelievable.
Hard fact : A very few people are able to reach even 1 crore milestone in their careers.
Good news is that the initial draft of Direct Tax Code has proposed that new contribution to EPF be taxed on withdrawal. However , the revised draft has made EPF fully tax exempt making it once again one of the best debt option available in the market.
Try not to touch your EPF account till you hang your boots. You may have to use it during acute emergencies but other than that avoid poking into this account while you are working. Its not uncommon of people to withdraw their PF at the stage. Government discourages you to withdraw money as withdrawals from EPF within five years of joining are taxable. Early withdrawal don’t allow power of compounding to come to play.
Lesson for everyone - Do not withdraw money from EPF while switching jobs , one should transfer the balance to the new account with the new employer. Remember , this do not happen automatically. You need to fill a ‘Form 13' and deposit it with the EPFO. Make this one of your first TODO’s things at new workplace as with course of time you will loose track of it and also get pre-occupied at new job.
EPFO in addition is coming up with a software enabling online transfer of money from old account to new account. This will reduce both the paperwork and time taken for transaction.

Positives of EPF :
Guaranteed returns :EPF is one of the safest debt instruments. Safety of principal and interest earned is very much there. Besides bring discipline in investing , it  serves well to accumulate a corpus for retirement.
Tax Exemption for Sure : The contributions you make towards provident fund gets you a tax benefit under Section 80C , upto a maximum limit of 1,00,000.
Interest rate fixed by government – The rate of interest on PF account is fixed eveny year during start of financial year by the government of India. The interest is for sure guaranteed and risk – free. The interest is credited to the members account on monthly running balance with effect from the last day in each year. The rate of interest is 9.5% for the year 2010-11 as notified by the Government.  Out of 12% (or 10% as the case may be) of the employer’s share of contribution, 8.33% is to be remitted towards pension fund.
VPF option : In addition if you fund your debt portion lagging in your portfolio , you can add more through voluntary increases in your contribution (VPF).
Do not Forget Loans Options against EPF -Your EPF balance can be used as a security for getting loans and thus makes your case strong for sanction of loan. Of course , it can also be utilized during acute emergency.
What if you do not withdraw and do not transfer ? – Earlier keeping money in old EPF account was not much of a disadvantage as the amount continued to earn interest till time of withdrawal. But from April 2011 , accounts which are inactive for more than 3 years will stop earning interest. So there’s a distinct disadvantage here apart from the fact that keeping multiple accounts can be a big pain. If accounts are located in different cities , it makes process more cumbersome. Also a single account gives you a better idea of your current corpus.
Once social security number which is currently being worked upon comes into picture , EPF accounts will be portable. So in such a scenario there will be no need to switch funds. The new employer will make all contribution to this account and completely independent of workplace.

Subject:- Discontinuation of ad-hoc promotion of officials of CSSS consequent upon refusal to accept regular promotion.

The undersigned is directed to say that it has been observed that some of the officials of CSSS, when promoted on regular basis and nominated to some other Cadre Units as per the Rotation Transfer Policy of this Department, are reluctant to move out of their present Cadre Units and subsequently refuse regular promotion with a view to be retained in their Cadre Units. Consequently, they are debarred of promotion as per the instructions of this Department. However, they continue to be appointed/promoted on ad-hoc basis during currency of the debarment by the Cadre Units.
2. On a reference from one of the participating Cadre Unit of CSSS, the matter has been examined in consultation with Establishment Division of the Department and it has been decided that the official who has refused regular promotion and consequently debarred shall not be appointed/promoted to the next higher grade on ad-hoc basis during the currency of debarment.
3. Accordingly, all Cadre Units are requested to immediately discontinue the ad-hoc promotion of the officials of CSSS who have refused to accept their regular promotion and consequently debarred from promotion for a specific period. Copies of order of their discontinuation of ad-hoc promotion may be endorsed to thisDepartment for record.

Sub: Grant of Child Care Leave to widower Railway employee in the event of death of wife left behind two surviving children
       Railway Board vide letter No.E(P&A)I-2008/CPC/LE-8 dated 23.10.2008 have issued orders for grant of Child Care Leave to women employees having minor children for a maximum of two years(730 days) during their entire service for taking care of up to two children for rearing/looking after any of their need, like examination, sickness etc. During the period of such leave, women employees shall be paid leave salary equal to pay drawn immediately before proceeding on leave. Child Care Leave shall not be debited against leave account.
      A case has come to our notice where a Railway Servant who has not re-married after death of his wife, and therefore, he has to take care of his children up to the age of 18-22(as a normal and disabled) along with his normal duties,single handedly.
      It is felt that in case wife of an employee expires and he does not marry, Child Care Leave Care Leave may be extended to widower employee, looking into the condition of needy Child Care Leave up to his re-marriage. Such types of cases are very few and therefore can be considered with minimum cost to the exchequer.

Sub: Comparison of grades of running staff with those of stationary staff for the purpose of promotion/selection to Group’B’ posts.
In terms of Board’s letter of even number dated 02.02.2006 (RBE No.10/2006), Railways/PUs were advised that instructions issued vide Board’s letter No. E(NG)l/89/PM2/8-A dated 10.1.92 and letter No. E(NG)I-98/PM2/8 dated 1.10.99, regarding equivalence of grades of running staff with that of stationary staff for the purpose of promotion to the posts in stationary categories, where both running and stationary staff were eligible and were considered together, would be applicable for determining eligibility of the candidates for promotion to the respective Group’B’ posts.
2 The question of equivalence of grades has since been reviewed in the light of the scales of pay introduced on the basis of scales of pay recommended by the Sixth Central Pay Commission, and it has been decided that for the purpose of determining eligibility of the candidates for promotion/selection to Group’B’ posts, the grades of running staff may be equated with those of the stationary staff as indicated below:

SubjectOutsourcing of dental services in CGHS Delhi- Division ‘A’(South & Central Zone).

It is brought to the notice of all concerned that Dental Service in CGHS Delhi in (Division ‘A’ Consisting of South & Central Zone) has been outsourced in 13 Wellness Centres as per list enclosed for 22 Dental Procedures which can be availed by the CGHS beneficiaries at designated Wellness Centres.
2. All CGHS beneficiaries may go directly to the Outsourced Dental clinics for treatment. On providing his/her CGHS card along with a self attested photocopy, the beneficiary will get treatment for approved procedure only in Outsourced Dental clinics on credit basis for both serving &pensioner CGHS beneficiaries. They would be requires to endorse the payment voucher/invoice generated by the outsourced Dental clinics at predetermined CGHS Rates. Access to Dental Care Services within CGHS Wellness Centres will be as follows:
(i) 0730 to 1330 hours: Exclusively for CGHS patients;
(ii) 1330 to 1930 hours: Private patients and CGHS patients (On Appointment/ First-come-first-served basis
3. However, the beneficiary shall have the option to avail the dental services at CGHS Empanelled Dental Centres/ Government Hospitals & polyclinics as will. Rate for complete denture has been fixed at Rs.1,900/- (one thousand and nine hundred only). In case any beneficiary opts for costlier dentures, he/she will have to pay the differential amount to the service provider and the beneficiary shall give an undertaking to the effect that the differential amount shall not be claimed from the CGHS.

Subsequent to classification of MTS as Group ‘C’, a number of references have been received in this HQrs office seeking clarification on issue of Uniforms/Liveries to erstwhile Group D employees.
2. The matter has been examined in this HQrs office and the clarification is as under :

3. The cases regarding admittance of Liveries/Uniforms to erstwhile Gp.D employees, now designated as MTS, may be regulated accordingly.

2. The fixed medical allowance has been enhanced from ‘100/-pm to 300/-pm with effect from 01.09.2008. Ex Servicemen who retired after
01.04.2003 have to become member of ECHS compulsorily and are not eligible to draw Fixed Medical Allowance. However, all Pre 01.04.2003 retirees have the option of either joining the Scheme or draw Fixed Medical Allowance as per the extant rates.
3. The other conditions for grant of Fixed Medical Allowance as brought out in this Office Circular No. 208 quoted under reference shall continue to be in force. PDAs are requested to please review the cases and revise the Fixed Medical Allowance in all the affected cases accordingly.

AIRF has toughned its stance on long pending demands of Railwaymen & retiterated its demands in Resolution adopted by AIRF during its Working Committee meeting on 25-26/04/11. Main demands are given as under:-
* Immediate settlement of recommendations of the Department Anomaly Committee pending with the DoP&T/MoF
* Complete Cadre Restructuring Exercise without putting the condition of “Matching Savings”.
* Merge the grade pay of Technicians Grade-II(GP Rs.2400) with Technicians Grade-I(GP Rs.2800).
* Allot Grade Pay of Rs.4800 to all the Senior Supervisors.
* Removal of anomaly in the annual increment to the employees drawing increment from February to June 2006.
* LARSGESS should be liberalized and extend to all the categories of the Railwaymen and recruitment qualification in Grade Pay Rs.1800 be kept VIII class pass.

Incentive limit increased to 70% in Chittaranjan Locomotive Works

        Ref: CME/Loco/CLW's letter no.PE/PLO/03 dated 07.02.11.
        Ministry of Railways have approved the Special Incentive Scheme as proposed by CLW subject to the following :-
        1. Incentive bonus limit to be 70%.
        2. Simultaneously, allowed timings should be reduced by 2.5 % at 60% level (with cuts in allowed time being linearly indexed to increase in incentive earning between 50% & 60%, with 0% cut at 50% earning and 2.5% cut at 60% earning).
        3. Allowed time to be further reduced by 1% at 70% level using the same formula of linear indexing between 60-70%.
        5. GM/CLW to advise a time bound target of the implementation of proposed Group incentive Scheme at CIW. All out efforts may be made for switching over to GIS at CLW.
        6 This special incentive scheme is applicable for the year 2011-12. There will be no staff increase and all other terms and conditions would remain the same as were applicable for the year 2010-11.
           This issues with the Concurrence of Finance Dte. of the Ministry of Railways.

AICPIN for the month of March, 2011
All India Consumer Price Index Number for Industrial Workers (CPI-IW) on base 2001=100 for the month of March, 2011 remained stationary at 185 (one hundred and eighty five).
During March, 2011, the index recorded decrease of 4 points in Chennai centre, 3 points each in Warrangal, Tiruchirapally, Vadodara and Quilon centres, 2 points in 12 centres and 1 point in 17 centres. The index increased by 6 points in Srinagar centre, 5 points in Hubli Dharwar centre, 3 points each in Bhilai, Sholapur and Mysore centres, 2 points in 5 centres, 1 point in 13 centres, while in the remaining 21 centres the index remained stationary.
The maximum decrease of 4 points in Chennai centre is mainly on account of decrease in the prices of Rice, Onion, Garlic, Vegetable items, Flower/Flower Garlands, etc. The decrease of 3 points each in Warrangal, Tiruchirapally, Vadodara and Quilon centres is due to decrease in the prices of Rice, Arhar Dal, Onion, Garlic, Vegetable items, etc. The increase of 6 points in Srinagar centre is the outcome of increase in the prices of Rice, Poultry (Chicken), Vegetable & Fruit items, Bus Fare, Tailoring Charges, Utensils Copper, etc. The increase of 5 points in Hubli Dharwar centre is due to increase in the prices of Rice, Goat Meat, Fish Fresh, Milk, Tea (Readymade), Pan Leaf, etc. whereas, the increase of 3 points each in Bhilai, Sholapur and Mysore centres is due to increase in the prices of Rice, Wheat, Milk, Coffee Powder, Firewood, etc.
The indices in respect of the six major centres are as follows :
1. Ahmedabad – 177
2. Bangalore – 188
3. Chennai – 163
4. Delhi – 169
5. Kolkata – 178
6. Mumbai – 183
The All-India (General) point to point rate of inflation for the month of March, 2011 remained static at 8.82% in comparison with the level of February, 2011. Inflation based on Food Index is 8.29% in March, 2011 as compared to 7.65% in February, 2011.

Following the notification of the Railway Services (Revised Pay) Rules, 2008 and issue of instructions vide Board’s letter No.PC-IV/2010/increment/1 dated 19.08.2010, this Ministry has received references from some Railways seeking clarification regarding grant of advance increments/special Allowance to Stenographers in subordinate offices for acquiring higher speed in Shorthand. An item has also been raised in DC/JCM regarding rate of above advance increment in the revised pay structure. The matter has been examined in consultation with Department of Personnel and Training and following clarifications are being issued:

1.Whether the Scheme of grant of one or two additional increments continues in the revised pay structure effective from 01.01.2006 or otherwise?

Whether those becoming eligible for the same w.e.f.01.01.2006 would be granted one/two increments @ 3% at the specific stage of Basic Pay, (Pay in Pay Band + Grade Pay) or alternatively first increment @ 3% of ?100 & second at 103 if hypothetically, the basic pay on the date of passing of Stenography test happens to be ‘100.

The increment @ 3% will be counted on the specific stage of Basic Pay (Pay in Pay Band + Grade Pay) the Railway Servants are drawing on the date of passing of Stenography test.

3.As per existing scheme (Boards letter No.PC-III/74/INC/3 dated 07.11.1975) date of next increment after the grant of advance increments should remain the same. Since above additional increments are to be treated as pay forall purposes as per Board's letter No.PC-IV/2010/Incrernent/1 dated 19.08.2010, it may please be clarified whether next normal increment will be granted to the concerned official on next 1st July ignoring date of grant of above additional increments in between or otherwise?

4.As per existing scheme, above additional increments are admissible till promotion to higher post and these are not counted for fixation on promotion. It may please be clarified whether consequent upon the instruction dated 19.08.20 10 of Board, above increments would be reckoned for fixation of pay in the higher post.

OFFICE MEMORANDUM
Subject: Medical Facilities for inpatient treatment and post-operative follow-up treatment to CGHS Beneficiaries in Non-CGHS areas.
The undersigned is directed to invite attention to the Office Memorandum of even number dated 30th September, 1999, issued by the Ministry of Health & Family Welfare on the above subject and to state that keeping in view the difficulties being faced by the pensioner CGHS beneficiaries residing in non-CGHS covered areas, it has now been decided to liberalise the CGHS Rules with regard to pensioner CGHS beneficiaries and serving employees, as below, to enable them to avail medical facilities for in-patient treatment and post-operative follow-up treatment:
a) (i) CGHS pensioner beneficiaries (and their dependant and eligible family members), who are holding a valid CGHS Card and are residing in a non-CGHS areas shall be eligible to obtain treatment from Government hospitals (Central Government / State Government / Local self Government / hospitals recognised under Central Services (Medical Attendance) Rules, 1944 / hospitals and clinics empanelled under Ex-Servicemen Contributory Health Scheme (ECHS) and submit the medical reimbursement claim to the Additional Director / Joint Director of CGHS of the CMO in charge of CGHS Wellness Centre, where the CGHS is registered.
(ii) In case of non-emergency treatment from hospitals approved under Central Services (Medical Attendance) Rules, 1944 and Ex-Servicemen Contributory Health Scheme (ECHS), it is necessary to obtain prior approval from CMO in charge of concerned Wellness Centre where the CGHS card is registered.
(iii) In case of medical emergency, treatment may be obtained from any hospital and medical claim shall be submitted to Additional Director / Joint Director, CGHS of the concerned city through CMO in charge of the Wellness Centre, where the CGHS card is registered.
(iv) Reimbursement shall be limited to the CGHS rates of the city where the card is registered and as per the ceiling rates and ward entitlements or as per actuals, whichever is lower.
(v) CGHS pensioner beneficiaries / serving Central Government employees (and their dependant and eligible family members) and holding a valid CGHS Card and on a visit to non CGHS covered area may obtain treatment under emergency from Government hospitals (Central Government / State Government / Local self Government / hospitals recognised under Central Services (Medical Attendance) Rules, 1944 / hospitals and clinics empanelled under Ex-servicemen Contributory Health Scheme (ECHS) and the medical claim shall be submitted to Additional Director / Joint Director, CGHS of the concerned city through CMO in charge of the Wellness Centre, where the CGHS card is registered, in case of pensioners , etc., and to the concerned Ministry / Department / office in case of serving employees.
(vi) Reimbursement shall be limited to the CGHS rates of the city nearest to the place, where treatment is obtained and as per the ceiling rates and ward entitlements or as per actuals, whichever may be less.
b) (i) CGHS pensioner beneficiaries (and their dependant and eligible family members) , who are holding a valid CGHS Card and residing in a non-CGHS areas shall be eligible to obtain post operative follow-up treatment from Government hospitals (Central Government / State Government / Local self Government / hospitals approved under Central Services (Medical Attendance) Rules, 1944 / hospitals and clinics empanelled under Ex-servicemen Contributory Health Scheme (ECHS) in follow up cases of Renal Transplant surgery, Knee and Hip Joint Replacement, Cancer treatment , Neuro-surgery and cardiac surgery. However, prior permission is to be obtained from the CMO in charge of the concerned Wellness Centre, where the CGHS card is registered.
(ii) Permission shall be issued for 3 to 6 months at a time and may be extended based on medical requirement. Reimbursement for consultation, procedures and investigations shall be limited to CGHS rates of the city, where the card is registered and as per the ceiling rates and ward entitlements or as per actuals, whichever may be lower. OPD medicines shall be obtained from the concerned Wellness centre for a maximum period of 3 months at a time.
c) Wherever treatment is obtained from a hospitals approved under Central Services (Medical Attendance) Rules, 1944 / ECHS approved hospital, the beneficiaries (as in (a), (b) & (c) above) shall submit a certificate from the hospital that they have not charged more than the approved applicable hospitals approved under Central Services (Medical Attendance) Rules, 1944 / ECHS rates.
d) This Office Memorandum supersedes the earlier OM of even number dated 30th September 1999.
e) This arrangement is provisional and would be in place till such time the proposed Health Insurance Scheme for Central Government employees & pensioners is brought into effect.
f) These orders will come into effect from the date of issue.

An Office Memorandum has been published by the J&K State Government today, stated that the pensioners and family pensioners of Jammu and Kashmir Government, who are attaining the age of 70 years and above as on 1st April, 2011, shall be paid pension revision arrears equivalent to 505 of total accrued amount in equal annual instalments as under:

The undersigned is directed to state that the AIRF’s letter under reference was put up to the Board, who have observed that since the decision as regards recovery of excess amount of Transport Allowance paid in three cities viz., Lucknow, Nagpur and Jaipur has been taken by the nodal department i.e. Ministry of Finance, meeting with the officials of Railway Board is not going to change the situation. However, if the Federation can come out with new facts pertaining to the case, the same could be referred to the Ministry of Finance for reconsideration.
As regards the source of information of recoveries made in the concerned cities, it is mentioned that the said information has been duly collected from the concerned zonal Railways.

Central govt employees’ retirement age to be extended by 2 years to 62
New Delhi: The government is planning to extend the retirement age of all central government employees by two years — from the current 60 to 62 years. Sources said that an in-principle decision has been taken in this regard and the department of personnel and training (DoPT) has begun the work to implement the same. A formal announcement to this effect is expected this year itself.
The last time the government extended the retirement age of central government employees was in 1998. It was also a two-year extension from 58. This was preceded by the implementation of the 5th Pay Commission, which had put severe strain on government’s finances. Subsequently, all state governments followed the Centre’s policy by extending the retirement age by two years. Public sector undertakings followed suit too.
The decision to extend the retirement age is well-timed both politically and economically.
The UPA government reckons the move would be a masterstroke. At a time when it is buffeted by several corruption cases, it is felt that the extension of the retirement age will go down well with the middle classes. Economically also, the move makes sense because by deferring payment of lump sum retirement benefits for a large number of employees by two years, the government would be able to manage its finances better. “An in-principle decision has been taken to increase the retirement age by two years within this year itself. This would reduce the burden on the fisc from one-time payment of retirement benefits for employees including defence and railways personnel,” an official involved in the discussion said. With the fiscal consolidation high on the government's agenda, this deferment would come handy.
There’s some flip side too if the retirement age is extended by two years. Those officials empanelled as secretaries and joint secretaries would have to wait longer to actually get the posts. And of course, there is the issue of average age profile of the civil servants being turning north.
It is also felt that any extension is not being fair with a bulk of people who still look for jobs in the government.
However, officials point out that at least it prevents an influential section of the bureaucracy to hanker for post-retirement jobs with the government like chairmanship of regulatory bodies or tribunals.
“As it is, a sizeable section of senior civil servants work for three to five years after the retirement in some capacity or the other in the government,” said a senior government official. The retirement age of college teachers and judges are also beyond 60.
As per a study, the future pension outgo for the existing Central and State government employees is estimated at a staggering R1,735,527 crore or 55.88% of GDP at market prices of 2004-05.

Payment of Fee of RTI Act through Indian Postal Order

Subject:- Payment of fee under the RTI Act by Indian Postal Order.

The undersigned is directed to say that the Right to Information (Regulation of Fee and Cost) Rules, 2005 provide that a person seeking information under the RTI Act. 2005 can make payment of fee for obtaining information by cash or demand draft or banker's cheque or Indian Postal Order. It has been brought to the notice of this Deportment that some pubic authorities do not accept fee through the Indian Postal Orders.

2. As stated above, one of the approved modes of payment of fee under the Rules is through Indian Postal Order. Refusal to accept tee through the IPO may be treated as refusal to accept the application. It may result into imposition of penalty by the Central Information Commission on the concerned Central Pubic Information Officer under Section 20 of the Act. All the pubic authorities should, therefore. ensure that payment of fee by IPO is not denied.
