Strengthening of Vigilance set up in Central Govt.

The Government had constituted a Group of Ministers (GoM), on 6th January, 2011 with the approval of the Prime Minister to consider measures that can be taken by the Government to tackle corruption. One of the terms of reference (ToR) of the GoM was to consider and advise on ‘Fast tracking of all cases of public servants accused of corruption “. The GoM, while considering this (ToR) also considered certain important recommendations of the Hota Committee (Committee of Experts to review the procedure of Disciplinary/Vigilance Inquiries and recommended measures for their expeditious disposal) has made a recommendation that vigilance administration of the Central Ministnes/Departments may be strengthened.

This recommendation of the GoM has been accepted by the Government. Accordingly, and all Ministries/Departments are advised to strengthen their vigilance administration with requisite manpower with a view to ensuring expeditious disposal of disciplinary cases. The Ministries/Departments may, where appropriate, consider setting up of a monitoring cell to review and monitor the progress of all pending Disciplinary Inquiries on a day-to-day basis, with a view to ensuring their timely conclusion.

Appointment of IOs and POs in disciplinary cases

The Government had constituted a Group of Ministers (GoM) on 6th January, 2011 with the approval of the Prime Minister to consider measures that can be taken by the Government to tackle corruption. One of the terms of reference (ToR) of the GoM was to consider and advise on "Fast tracking of all cases of public servants accused of corruption". The GoM, while considering this ToR also considered certain important recommendations of the Hota Committee (Committee of Experts to review ¡he procedure of Disciplinary/Vigilance Inquiries and recommend measures for their expeditious disposal) and recommended that Departments/Ministries should primarily use serving officers as IOs & POs and that in important cases, they may request CVC to appoint their CDI as IO. The GoM has also recommended that the CVC may also maintain a panel of IOs/POs from amongst retired officers, whose services can also be utilized by various Ministries/Departments.

The above recommendations of the OM have been accepted by the Government and accordingly all Ministries/Departments are advised to use serving officers as IOs & POs and in important cases, request the CVC to appoint their CDI as IO. They may also, in appropriate cases, utilize the services of IOs/POs who would be available on the panel to be maintained by CVC, in consultation with CVC.

Permission to CBI to investigate Jt Secy & above

The Central Government has referred to the provision of section 6A of the DSPE Act, 1946 which provide for safeguarding senior public officials against undue and vexatious harassment by the investigating agency. It has been observed that the requests being made by the investigating agency under said provision were not being accorded due priority and the examination of such proposals at times lacked objectivity. The matter was under consideration of the group of Ministers constituted to consider measures that can be taken by the Government to tackle corruption.

The Government has accepted the following recommendations of the group of Ministers, as reflected in para 25 of the First Report of the Group of Ministers :

(a) The competent authority shall decide the matter within three months of receipt of request accompanied with relevant documents

(b) The competent authority will give a speaking order, giving reasons for his decision

(c) In the event a decision is taken to refuse permission, the reasons thereof shall be put up to the next higher authority for information within one week of taking the decision

(d) Since Section 6A specifically covers officers of the Central Government, above the rank of Joint Secretary, the competent authority in these cases will be the Minister in charge in the Government of India. In such cases, intimation of refusal to grant permission along with reasons thereof, will have to be put up to the Prime Minister.

The above decision of the Government is brought to the notice of Ministries/Departments for due adherence and strict compliance.

Disciplinary cases- II stage consultation with CVC dispensed with.

The Government had constituted a Group of Ministers (GoM), on 6th January, 2011 with the approval of the Prime Minister to consider measures that can be taken by the Government to tackle corruption. One of the terms of reference (ToR) of the GoM was to consider and advise on “Fast tracking of all cases of public servants accused of corruption ‘. The GoM, while considering this (T0R) also considered certain important recommendations of the Hota Committee (Committee of Experts to review the procedure of Disciplinary/Vigilance Inquiries and recommended measures for their expeditious disposal) and decided that second stage consultation with CVC in disciplinary matters may be dispensed with. However, in those cases where consultation with UPSC is not required as per extant rules/instructions, the second stage consultation with CVC should continue.

The above recommendation of the GoM has been accepted by the Government with the approval of the Prime Minister. All Ministries/Departments are, therefore, advised to strictly adhere to the new procedure with immediate effect.

The Central Vigilance Commission has been separately requested to amend its Vigilance Manual and other relevant instructions accordingly.

Recruitment of Stenographers in CSSS through SSC

In OM. of even number dated 20th September. 2011 vide which the nomination of 35 candidates of Stenographer Grade ‘D’ of CSSS for the Select List Year 2010 was issued by this Department the following decision has been taken by DOPT. The examination dossiers in respect of 09 more candidates for appointment as Steno Grade ‘D’ in CSSS have been received from SSC. Accordingly. they are nominated to the different Cadre Units of CSSS as listed in the Annexure to this Department’s O.M. in the order of their merit for appointment as Steno Grade ‘D’ of CSSS.

2. Since these candidates have neither been medically examined nor have their character and antecedents been verified, the Cadre Units are requested to complete their pre-appointment formalities before they are actually appointed as Steno Grade ‘D’ latest by 31.10.2011.

3. In accordance with ‘Instructions for the candidates’ relating to this Examination, qualified candidates are required to submit their original certificates for verification to the authority who will give them the Offer of appointment. The appointing authorities may, therefore, call for the original certificates and check the relevant particulars from them regarding date of birth, educational qualifications claims for OBC/SC/ST/Exservicemen/PH and claim in respect of age relaxation. If any discrepancy is found in any particular case, the SSC may also be informed about it with a copy to this Department.

SC/ST/OBC candidates is that of the appointing authority. The candidates may, accordingly, be offered appointments provisionally subject to their furnishing the prescribed caste certificate in the prescribed form within a reasonable time, which should be verified by the appointing authority.

5. In cases where the candidates are already employed in the Government offices, the Offer of appointment may be sent to them through their respective offices. Copies of Offer of appointment issued to them may kindly be forwarded to this Department and the Staff Selection Commission. The date of their joining the duty may also be intimated along with their roll number and rank number to this Department and Staff Selection Commission as soon as possible.

No. 9/23/ 71-Estt.(D) dated 6.6.78 as amended vide O.M. No.35015/2/93-EStt(B) dated 9.8.1995.

9. If any candidate fails to report for duty or there is no response or the offer is declined, after a registered reminder, the Offer of appointment should formally be cancelled and the candidate be informed accordingly. The dossiers of such candidates should be returned there after to the Staff Selection Commission directly under intimation to this Department after placing a copy each of the Offer of appointments reminder thereof and the cancellation memo, in the respective dossier. The dossier(s) should be returned under the signature of the officer to whom the same were sent in your office. He/She should also sign the list of dossier(s) which is/are returned with the letter.

10. These Steno Grade ‘D’ would be nominated for induction training in the ISTM shortly. The dates of the induction training programme would be intimated to all the Cadre Units in due course. All the Cadre Units shall relieve these Stenographers Grade ‘D' for the induction training programme in the ISTM as and when they are nominated.

11. All Cadre Units of CSSS are requested to ensure that in case some staff have been outsourced for stenographic assistance by showing the vacancies of Steno Grade ‘D’, the same may be reduced proportionately keeping in view the number of Steno Grade ‘D’ nominated to the respective Cadre Units. The Financial Advisers of all the Cadre Units are also requested to ensure that outsourced stenographic assistance is proportionately reduced as the nominated Steno. Grade ‘D’ join in the Cadre Unit.

Free Roaming in India on Mobile

It is good news for Mobile users that mobile portability in India will be free. Earlier this facility is available only in region. Now telecom operators can use a single licence for operations in various parts of the India. There will be no difference between Local and STD calls, as the Policy aims at a 'One-Nation-One-Licence' regime.

Hon'ble Telecom Minister Kapil Sibal has said that "We will seek Telecom Regulatory Authority of India (TRAI) recommendations on new licences, migration to new licences and exit pocliy." while releasing the draft policy.

In the wake of the 2G scam, the minister said spectrum allocation would be delinked from licences and radiowaves would be made available at market-determined prices.

As the market is crowded with too many players, the government would also bring an exit policy.

With regard to spectrum, Sibal said the government would provide a roadmap for additional spectrum availability every five years and also make its periodic audit mandatory to ensure that the scarce resource is used efficiently.

The draft NTP has also set an ambitious target of providing broadband services on demand by 2015 with a target of 600 million such high-speed Internet connections by 2020.

The draft NTP has went to the extent of likening the broadband connectivity to basic necessities like health and education and proposes to work towards a 'Right to Broadband' for every citizen.

The policy has also called for providing by the year 2015, the 'Broadband on Demand' services, which would enable affordable, across-the-country, round-the-clock and high-speed Internet connectivity to the users.

"The primary objective of National Telecom Policy (NTP)-2011 is maximising public good by making available affordable, reliable and secure telecommunication and broadband services across the entire country," Sibal said.

The draft NTP-2011 aims to achieve 175 million broadband connections by the year 2017 and 600 million by the year 2020.

It also aims to converge mobile telephony, multimedia and broadcast services, to offer superior experience to customers.

"We want to reposition the mobile phone from a mere communication device to an instrument of empowerment that combines communication, with proof of identity, fully secure financial and other transaction capabilities, multi-lingual services and a whole range of other capabilities that ride on them and transcend the literacy barrier," Sibal said.(ST-10/10)

Promotion of Assistant to the grade of Section Officer of CSS

Referring to OM No. 6/9/2010-CS-I(S) dated 11.11.2010, 07.04.2011 and 06.07.2011, DOPT has taken following decision.

2. Considering the fact that posts are lying vacant in the Section Officers’ Grade in various Ministries/Departments mainly on account of court cases, it has been decided that eligible Assistants (who have completed 8 years of approved service in the grade of Assistant) upto SCSLs 2002 (Gen. & SC) may be promoted to the grade of Section Officer on ad-hoc basis to the extent of vacant posts available in the Cadre Units upto 31,10.2011. All the eligible Assistants of ST category upto SL 2002 were already promoted on ad-hoc basis vide OM No. 6/9/2010-CS-I(S) dated 11.11.2010. The ad-hoc promotion/appointment would be subject to the following conditions:

(i) The period of ad-hoc promotion would be upto 31.12.2011 or till the regular Section Officers are made available, whichever is earlier;

(ii) The ad-hoc appointments shall not confer on the appointees any right to continue in the grade indefinitely or for inclusion in the Select List of Section Officers for regular appointment or to claim seniority in the Section Officers grade of CSS;

(iii) Ad-hoc appointments would continue till regular candidates in Section Officer Grade are available either through Seniority Quota or Limited Departmental Competitive Examination (LDCE). In the event of the ad-hoc appointees not qualifying for regular appointment in either of these two categories, they will be reverted to the Assistants’ Grade on availability of such regular officers from the date they (regular Section Officers) join duty in their respective cadre units allotted to them by this Department

(iv) The effective date of ad-hoc promotion in respect of those found fit and clear from vigilance angle would be the date from which the officer concerned joins duty in Section Officers’ grade in his own cadre unit.

3. If any of the Officers, who is eligible for promotion in Section Officer grade on ad-hoc basis and is on deputation, he/she may be given option to revert within one month with a view to avail of the promotion on ad-hoc basis.

4. All the Cadre Units are requested to take urgent action to conduct DPCs in respect of all the Assistants within the Zone prescribed as at Para 2 above and to promote eligible Assistants to the grade of Section Officer on ad-hoc basis to the extent of vacancies available upto 31.10.2011. A copy of the appointment order may be endorsed to this Department.

5. The recommendations of the DPC in respect of the remaining eligible Assistants in the above zone, who are clear from vigilance angle and cannot be promoted by 31.10.2011 within the Cadre Unit due to lack of vacancies, may be forwarded to this Division by 15.11.2011 so that they could be promoted against existing vacancies in SO grade elsewhere.

6. It has also been decided that the period of ad-hoc promotion allowed upto 30.09.2011, in the case of existing ad-hoc Section Officers as communicated vide OM No. 6/9/2010-CS.I(S) dated 06.07.2011, may be extended upto 31.12.2011 subject to the conditions as prescribed in para 2 of this OM.

7. After the completion of the process as indicated in Para 4 & 5 above, all the Cadre Units are requested to convey the following information by 15.11 2011:

(i) The details of the Assistants promoted on ad-hoc basis in SO grade after the issue of this order (Annexure- I)

(ii) DPC recommendations in respect of the remaining eligible Assistants in the zone prescribed as indicated in Para 5 above (Annexure-II).

E-Brochure on Reservation for SC, ST and OBC released by DOPT

Department of Personnel and Public Grievances and Pensions has issued an E-Brochure on Reservation for SC, ST and Other Backward Classes in Central Services.

The circulars related to Brochure on Reservation have also been published by DOPT in its official Website.

The following is the foreward of this brochure.

A Brochure on Reservation for the Scheduled Castes and Scheduled Tribes in Services was last brought out in the year 1993. An important event, namely, introduction of reservation for Other Backward Classes in services under the Union Government took place in that year. The 1993 edition of the Brochure only contained Office Memoranda on reservation for OBCs but did not form an integral part thereof. It is for the first time that a Brochure on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes is being brought out.
2. A major development in the matter of reservation was the replacement of `vacancy based reservation' by the 'post based reservation' in the year 1997. This brought in drastic changes in the way the reservation system was implemented. Problems raised by various stake-holders in connection with the new system of implementation of reservation were attempted to be solved by explaining the issues to the concerned organizations individually, but doubts still continue to be raised. The Reservation Division of this Department led by Shri Rajeev Kapoor, Joint Secretary, and Shri K.G. Verma, then Director have prepared a comprehensive Brochure, covering various aspects of the subject.The difficulties faced by the people in understanding the provisions of reservation have been kept in view while preparing the Brochure. The subject has been presented in a simple language and is easy to comprehend.
3. Efforts have been made to make this document error free. Nevertheless, if any error is noticed, it may be brought to the knowledge of the Joint Secretary of Reservation Division of the Department of Personnel and Training.

Grant of Financial Up-gradation under MACP Scheme (MACPS)

Grant of Financial Up-gradation under MACP Scheme (MACPS)

Office of the JS(Trg.) & CAO has issued an important clarification order regarding financial upgradation to the higher Grade pay under Modified Assured Career Progression Scheme (MACPS). The order said that in terms of Dopt’s instructions issued vide their O.M. No.35034/3/2008-Estt.(D) dated 19.5.2009.

The competent Authority has approved grant of financial upgradation to the officers, those who have completed 30 years of service as on their date of 3rd financial upgradation under MACP. Financial upgradation has approved to the Grade pay of Rs.4800 in Pay band-2 and the Grade pay of Rs.6600 in the Pay band-3 under MACP scheme to eligible officers of AFHQ Civil Service.

Financial upgradation under the MACPS shall be purely personal to the officer concerned and shall have no relevance to his seniority position. As such, there shall be no additional Financial upgradation for the senior officers on the ground that their juniors in the grade have got higher pay/grade pay under the MACPS.

The benefit of pay fixation available at the time of regular promotion is allowed at the time of financial upgradation as well to the officer concerned. As such, the above officials have an option under FR 22 (1) (a) (1) to get their pay fixed in the higher pay/ grade pay either from the date of their upgradation or from the date of their next increment viz. 1st July of the year. The pay and the date of increment would be fixed in accordance with clarification No. 2 of the Department of Expenditure O.M. N0.1/1/2008-1C dated 13.09.2008 whereby the pay shall be raised by 3% of the total pay in the pay band and the grade pay drawn before such upgradation.

There shall, however, be no further fixation of pay at the time of regular promotion, if it is in the same grade pay as granted under MACP Scheme.

SC/ST/OBC candidates is that of the appointing authority. The candidates may, accordingly, be offered appointments provisionally subject to their furnishing the prescribed caste certificate in the prescribed form within a reasonable time, which should be verified by the appointing authority.

6. The Offers of appointment should be sent only by Registered Post. If the postal authorities return the letters undelivered, the letters along with the envelopes containing remarks by the postal authorities should be retained for record. In such cases a copy of the offer of appointment should be
sent to the permanent address of the candidates, if it is different from that of the initial mailing address. The dossiers of such candidates should be returned to the SSC only if the second letter is also returned undelivered under intimation to this Department.

8. The dossiers of candidates are forwarded herewith and these should be retained, on their appointment in the Ministry/Department /Office, as part of their Service Book. It may specially be noted that the dossier shall be deemed lo be authentic only if the photograph of the candidate in the
dossier is EMBOSSED with the special stamp of the SSC. Before taking any further action, it may please be ensured that the photograph of the candidate in the dossier is duly embossed and in case any discrepancy is noticed, the matter may be referred to the SSC without any delay.

TRAI/DND/Register DND or De-Register DND mobile SMS services

Telecom Regulatory Authority of India (TRAI) has stopped to all SMS service provider to send commercial SMS to those numbers who are registered in DND. Group SMS is also restricted by TRAI. In the interest of customer , it is necessary to know how a customer or phone user can Register himself for DND (Do Not Disturb) service or De-Register for DND service.

AAkash-The Cheapest Tablet net book launched in India

The Release of Android OS driven Tablet for Rs.1700 (US$ 35) was among the top of widely spread media news this week.

This tablet net book is to be sold in India in the name "AAkash Ubislate". A Canadian based Company known Datawind Ltd., is the manufacturer. This company is run by two Indians; Suneet and Raja Tulli. This company is already a leading developer of wireless web access products and services.

Recently HRD minister Kapil Sibal released this tablet. It is announced by Government that it is going to provide subsidy for supply of this tablet to students. As a result for student this will cost around Rs.1700. The Govt. of India even distributed 500 free tablets to students from different parts of India who had come to attend the event.

It is announced by Datawind that retail price of this tablet will be around Rs.3000. At this price, AAkash Ubislate will be cheapest tablet ever released.

The tablet meant for retail sales which is to be sole at Rs.3000/- will have an inbuilt cellular modem and SIM to access internet. So, this device is mobile GPRS internet connection enabled. This feature will not be available in the subsidized devices which are to be distributed at the cost of Rs.1700.
The subsidized version will have only WiFi connectivity provision. This means we require a WiFi modem externally to connect to the internet.
Both versions of the tablet are equipped with a 7-inch touch screen and will run on Google's Android platform, with WiFi connectivity for internet access and cloud storage.
The tablets will have 256 MB of RAM and two USB ports. It has no hard disc. However, a slot for inserting 32 GB MicroSD card (expandable memory) is available.
So, the device at a retail price of Rs.3000/- has both GPRS and Wi-Fi connectivity and available with an affordable Internet plan of Rs.98 per 2GB. This version can also be used as a phone by inserting a SIM card and headphones.

Ad Hoc bonus for RPF/RPSF Personnel

The Ministry of Railways has decided to grant ad hoc bonus equal to 30 days of emoluments. for the group C and D Personnel working in RPF/RPSF.. The Calculation of ceiling of Rs. 3,500 would continue to be same. The method of calculation and eligibility to various categories of persons are detailed in the Railway Board Order.

Full Text of Railway Board Order No.E(P&A)II-2001/Bonus-1 dated 05.10.2011 is given below :

SUBJECT: Grant of ad-hoc bonus for 30 days to the Group C & D RPF/RPSF personnel for the financial year 2010-2011.

The President is pleased to decide that all Group C and D RPF/RPSF personnel, may be granted ad-hoc bonus equivalent to 30 (thirty) days emoluments for the financial year 2010-2011, without any eligibility wage ceiling. The calculation ceiling of Rs.3500/- will remain unchanged.

2. The benefit will be admissible subject to the following terms and conditions:

a) Only those Group C & D RPF/RPSF personnel who were in service on 31.3.2011 and have rendered at least six months of continuous service during the year 2010-2011 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible personnel for period of continuous service during the year ranging from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded to the nearest number of months).

b) The quantum of ad-hoc bonus will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate ad-hoc bonus for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will there after be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of Rs.3500/- (where actual average emoluments exceed 3500), ad-hoc bonus for thirty days would work out to 3500×30/30.4 = Rs.3453.95 (rounded off to Rs.3454/-).

c) All payments under these orders will be rounded off to the nearest rupee.

d) In the matter where the aforesaid provisions are silent, clarificatory orders issued vide this Ministry’s letter No.E(P&A)II-88/Bonus-3 dated 29.12.1988, as amended from time totime, would hold good.

e) All the Group C & D RPF/RPSF personnel. regardless of whether they are in uniform or out of uniform and regardless of place of their posting, shall be eligible only for ad-hoc bonus in terms of these orders.

Sub: Payment of Dearness Allowance to Railway employees - Revised rates effective from 01.07.2011.

Please refer to this Ministry’s letter of even number dated 25.03.2011 (S.No.PC-VI/251, RBE No.40/2011) on the subject mentioned above. The President is pleased to decide that the Dearness Allowance payable to Railway employees shall be enhanced from the existing rate of 51% to 58% with effect from 1st July, 2011.

2. The provisions contained in Paras 3, 4 & 5 of this Ministry’s letter of even number dated 09.09.2008 (S.No.PC-VI/3, RBE No. 106/2008) shall continue to be applicable while regulating Dearness Allowance under these orders.

3. The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all railway employees. The arrears may be charged to the salary bill for October, 2011 and no honorarium is payable for preparing separate bill for this purpose.

4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Steve Jobs, whose death was announced on Wednesday night, wasn't a computer scientist. He had no training as a hardware engineer or an industrial designer. G.S.R. (E). – Whereas, the designated authority vide notification No. 15/2/2010-DGAD, dated the 8^th June, 2010, published in the Gazette of India, Extraordinary, Part I, Section 1 dated the 8^th June, 2010, had initiated review, in terms of sub-section (5) of section 9A of the Customs Tariff Act, 1975 (51 of 1975) and in pursuance of rule 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 (hereinafter referred to as the said rules), inter alia in the matter of continuation of anti-dumping duty on Caustic Soda (hereinafter referred to as the subject goods) falling under Chapter 28 of the First Schedule to the Customs Tariff Act 1975, (51 of 1975),originating in, or exported from, Korea RP (hereinafter referred to as the subject country), imposed vide notification of the Government of India in the Ministry of Finance (Department of Revenue), No.137/2008-Customs, dated the 26^th December, 2008, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R.889(E), dated the 26^th December, 2008;

And whereas, in the matter of Mid-term review of anti-dumping on import of the subject goods, originating in, or exported from, the subject country, the designated authority vide its final findings No. 15/2/2010-DGAD dated the 7^th July, 2011, published in the Gazette of India, Extraordinary, Part I, Section 1, dated the 7^th July, 2011, had come to the conclusion that-

(i) the subject goods had been exported to India from the subject countries below its normal value;

(ii) the domestic industry had suffered material injury;

(iii) the injury had been caused by the dumped imports from subject countries.

and had recommended imposition of definitive anti-dumping equal to the lesser margin of dumping on imports of the subject goods, originating in, or exported from, the subject country, so as to remove injury to the domestic industry;

Now, therefore, in exercise of the powers conferred by sub-section (1) read with sub-section (5) of section 9A of the said Customs Tariff Act, 1975 read with rules 18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, the Central Government, on the basis of the aforesaid findings of the designated authority, hereby imposes on the subject goods, the description of which is specified in column (3) of the Table below, falling under sub-heading of the First Schedule to the said Customs Tariff Act, specified in the corresponding entry in column (2), originating in the country specified in the corresponding entry in column (4), and exported from the country specified in the corresponding entry in column (5) and produced by the producer specified in the corresponding entry in column (6) and exported by the exporter specified in the corresponding entry in column (7), and imported into India, an anti-dumping duty at a rate which is equivalent to the difference between, the amount specified in the corresponding entry in column (8), in the currency specified in the corresponding entry in column (10) and per unit of measurement specified in the corresponding entry in column (9) of the said Table, and the landed value of such imported goods in like currency per like unit of measurement.

2. The anti-dumping duty imposed under this notification shall be effective up to and inclusive of 25^th December, 2013 with effect from the date of publication of this notification in the official Gazette and will be paid in Indian currency.

Explanation. – For the purpose of this notification,-

(a) “landed value” means the assessable value as determined under the Customs Act, 1962 (52 of 1962) and includes all duties of customs except duties levied under sections 3, 3A, 8B, 9 and 9A of the said Act;

(b) “rate of exchange” applicable for the purposes of calculation of such anti-dumping duty shall be the rate which is specified in the notification of the Government of India, in the Ministry of Finance (Department of Revenue), issued from time to time, in exercise of the powers conferred by section 14 of the Customs Act, 1962 (52 of 1962), and the relevant date for the determination of the rate of exchange shall be the date of presentation of the bill of entry under section 46 of the said Customs Act.
